Minds in Mind Occupational Therapy Consulting - Terms & Conditions

1.Payments 

1.1  Fund/Plan Management:  

The plan nominee is responsible for monitoring the available funds. Funds are to be paid within 7 days of the date of invoice. If payment is not made in accordance with this Agreement we may discontinue supports and refer you to a 
collection agency. 

1.2  Goods and Services Tax 

We confirm that a supply of Occupational Therapy supports under this Service Agreement, GST will not be charged in accordance with A New Tax System (Goods and Services Tax) Act 1999 (GST Act), s38.10 ‘recognised professional.’ 

2.Cancellation policy 

A minimum of 24 hours notice is required to cancel an appointment without incurring a cancellation fee. 

Appointments cancelled within 24 hours may be charged at the full rate. This fee will be charged on top of the agreed hours within the existing service agreement. 

3.Changing or Ending the Service Agreement 

If changes to the supports or their delivery are required, you agree to discuss and review this Service Agreement with us. We both agree that any changes to this Service Agreement will be in writing, signed, and dated by both 

of us.  Either party may terminate this Service Agreement by providing the other party with two weeks’ notice. If either party seriously breaches this Service Agreement the requirement of notice will be waived. 

4.Required documentation 

Prior to commencing, I will require copies of the following: 

  • Family Court Order (if applicable) 

  • Guardianship Orders (if applicable) 

  • Administration Orders (if applicable) 

  • Previous psychiatric, allied health or medical reports 

  • Case plan (if child/young person is under GOCE) 

  • Cultural Maintenance Plan if Aboriginal or Torres Strait Islander 

5. Confidentiality, Privacy and Record Management 

5.1 Confidentiality and Privacy 

Treatment for the you/ your child/ young person under your guardianship is private and confidential. This means I will not disclose information about the child/ young person to third parties, including other treatment providers, unless you, 
as the legal guardian, consent for me to do so.  It is important to note that there are some limits to confidentiality where an occupational therapist is bound by the law or overarching ethical principles to disclose information. 

These include: 

  • If there is an immediate risk of significant harm to the client or an identifiable individual; 

  • Notifying the Department for Child Protection if a child is at significant risk of harm or has been abused or neglected; 

  • If case notes are subpoenaed by the courts, or disclosure is otherwise required or authorised by law; 

  • Reporting of serious crimes that have occurred or are about to occur; 

  • Reporting to the Register of Firearms when (i) there is cause to believe that the possession of a firearm by a client is unsafe for the person or any other person, and (ii) that the person holds or intends to hold a firearm license or 
    possesses or intends to possess a firearm; 

  • Mandated notifications about registered health clinicians under AHPRA Guidelines; 

  • In the process of seeking supervision as a part of continuing professional development. Please note that discussion of client information during clinical supervision is deidentified; 

If unauthorised access, disclosure, or loss of a client’s personal information occurs, action will be taken to address any exposure or compromise in systems, and any affected clients will be informed.

5.2 Health Record Management 

I will create and keep a confidential health record for you/ your child/ young person under your guardianship, which will record all relevant information relating to the treatment provided. I may also collect and store health information 
about the child/ young person from third parties such as their school or doctor. 

Client records and notes are stored electronically using practice management software, Halaxy, which is compliant with the Australian standards for online security and encryption. Information regarding the terms and conditions and

NovoPsych and Pearson Australia are often used to offer Occupational Therapy  assessment measures to clients and/ or their parents or carers. The Privacy Policy and Security information for these services can be found

By consenting to services provided by Anna Westlake Occupational Therapist and Director at Lewis & Westlake Consulting Pty Ltd, you are indicating your consent (for you/ the child/ young person/ the carer) to the use 

of NovoPsych, Pearson Australia and any additional third-party applications or websites you have provided additional consent for throughout service provision.   

Health records are managed and protected in accordance with the applicable state and federal laws. The law  requires that children’s health records be stored until 25 years of age. After that I will permanently delete electronic records and/or destroy any paper documents. Please don't hesitate to let me know if you have any questions or 
concerns regarding this. 

6. Limits to Services Provided 

I am a private provider of Occupational Therapy and Consultation. Treatment is provided via prearranged, scheduled appointments. I have limited availability for contact outside of scheduled appointment times and may 

not have an opportunity to respond to phone calls or emails in between sessions, so this should not be relied upon for emergency matters.  

I will only provide services that are within my professional capabilities, competence, and role as a private provider of Occupational Therapy services. If treatment needs are identified that are outside of this scope, I will 

endeavour to assist you in identifying alternate suitable providers for your self, your child/ young person under your guardianship. 

7. Emergency Contacts 

I cannot provide an emergency service and am not able to respond to urgent or emergency matters. Available communication channels (phone, SMS, email) are not monitored outside of limited business hours.
